All I care at the moment is I CAN NOT find a print on demand company with reasonable shipping rates. Printful calendar £20.10 + £16.99 shipping. I mean What The F… How are we supposed to make money with these companies. If you know please tell us.
I think the font designer has a very strong case, particularly given the information your disclosed in the video. For Zazzle to continue to use the font 2 years after a cease and desist….well, I wouldn’t want to be the company lawyer that advised them on that course of action.

I’ve had long discussions with numerous people (artists, fellow writers, and graphic designers). it was always going to tough for artists to win their lawsuits based on how it was written. Even as an author, I find that trying to restrict what AI can be trained on is similar to trying to prevent students from not analyzing and learning from your work. As long as it doesn’t spit out an exact copy of something then it doesn’t breach any copyright laws. If you work within any of the creative industries learning and understanding how copyright works is extremely important. Just like the AI issues that the screen actors guild is dealing with. If they understood copyright law then they would understand that production studios can’t use a person’s likeness for commercial profit without their consent. In regards to written and artistic works, you can’t copyright style so as long as it doesn’t produce a visual duplicate of a written or art piece of work then copyright claims have no legal foundation. I’ve constantly told people that if they want to try to win then they need to change their argument.
Some good points. I would be interested in hearing arguments that laws in-general should be modified or updated due to AI (also interested in hearing arguments opposite to that as well) but based on CURRENT laws, there doesn’t seem to be anything that Stable Diffusion/Midjourney are legally doing wrong.

I think the part the judge allowed is the only legal leg the artist have to stand on. I can see that an artist should be allowed to have their images removed from stable diffusion. That’s still iffy.

Yesterday I cancelled my $500 midjourney subscription. My prompts resulted in very beautiful illustrations when I first signed up but now after 8months they look like nothing even when using the same version. I’m an artist who thought that I could use MJ as a shortcut but it only made my workflow longer and more stressful. I now got back to creating my own art from scratch.

I mean who in their right mind would try to con a big company like Zazzle by using lawsuit card? this wouldn’t be news if the lawyer of the font owner aren’t sure that they wouldn’t win. I hope she wins and get what she rightfully earns if this is true.
On the surface I do agree, but there could be some sort of misunderstanding, because the artists in the Midjourney lawsuit also seemed to have some misunderstandings about how it works, yet sued it anyway for things it literally does not do. So that’s why I’m pretty curious to find out what happens if this goes to trial, to see the full story of what on earth happened as I haven’t heard Zazzles defence yet.
Ironically I advised a client within the last 6 months of the IP surrounding fonts, and that they should source a designer to create a font specifically for them, that they would then own the rights to, and make sure they were completely covered for the products they then created.
They both will. The artist WILL, and rightfully so, receive a lot of money for their work. However, I believe that it will be in the form of an undisclosed settlement amount, with the understanding that no one talks about it and the artist collects future royalties for its use. I’m not and expert, but that’s usually how these things seem to work.
Well, if any of these litigious artists went to school and were taught to be an artist by referencing other artist’s work, then they need to own up and pay out.
My partner is an artist and he’s very frustrated to see people make easy money by selling AI art. He’s lost several potential customers because they only want something quick and easy and cheap so who would want to pay a lot of money for someone’s hard work?
I get it, I really do. You’ve learned and worked for years just so someone else can use your work to create cheap images to sell for a penny. He’s fine with private use, no issues there. But, spending hours on your art and then someone comes along and earns money through your hard work is a bit of a slap in the face.
You should make a tutorial on managing assets and licenses 😊
