🤔 Do you think ChatGPT should be sued for copyright infringement? Or do you think it is Fair Use?
This reminds me of Napster, which enabled illegal sharing of copyrighted music in the 2000s. That ended up with properly-regulated, licensed, paid-for alternatives. These models are the norm nowadays for all creative outputs, and I’m sure that generative AI will inevitably go in the same direction once the lawsuits are over. I hope it does. It’s fairer for all.
I think it is fair use because it is altered enough.
It is the Napster era of AI Image Generation. It will eventually find a better and fairer business model, just like digital music has found.

Not to mention the previous controversy of home video recording and Hollywood’s attempts to stop it… Until they found a way to monetize it for themselves.
From my research, mugshots and other photos taken by government agencies are supposed to be public domain in the USA. The reason is because it was taken by a tax payer funded photographer. I am pretty sure that professor is wrong about Trump’s mugshot.
I had read that too, but honestly, the websites I had read that on were not particularly credible, whereas an actual interview with a law professor is. I was already skeptical of those websites stating mugshots are in the public domain due to them being government agencies, because I know for a fact, that that is false. That is why NASA having their images in the public domain is so remarkable. Most government agencies choose to retain their copyrights. There are only 2 federal agencies in the USA that I can think of, that open their images to the PD (NASA & the Parks/Recs department, I can’t think of their official name off the top of my head). The others don’t.
Yes, so, while a lot of what is created is in the public domain by the government in-general, images still often retain their copyright. If you look through their library of images in the public domain, it is actually a fairly limited selection. Most images created have the copyrights retained: https://www.loc.gov/free-to-use/ this is also not a federal agency, I believe that the Fulton Country State Department would fall under state law. I think. Haha

What legal rights, if any, Trump’s campaign may have over the mug shot’s reproduction are unclear, however. The photo was distributed by the Fulton County court to media outlets, including Reuters.
Mug shots taken by US federal courts are generally in the public domain, although Georgia’s state policy may be different.
Many U.S. states have “right of publicity” laws that prevent the use of a person’s image in commerce without their permission. Federal trademark law also bars false advertising and endorsements, and Trump would also likely be able to sue under other state laws.
But political parody goods may receive some protection from intellectual-property claims under the U.S. Constitution, and attorneys say that whether Trump would actually sue is more of a strategic question than a legal one.
“In all likelihood, given how polarizing Trump has been, and everything that is already in the marketplace around his likeness, it would not likely be a legal priority,” trademark attorney Josh Gerben said.

Federal agencies mugshots would be public domain. State agencies can decide on their own. Some states require the subject to agree so Donald Trump may be able to use his photo but not others. We don’t know Fulton County’s position.
Yeah it’s interesting, historically, the political niche has thrived in POD because it is extremely rare for any politician to invoke their right of publicity. Usually their photo is used to make fun of them, not support them (unique case here) however, it’s generally considered socially “beneath” a politician to take down. There are very few cases a politician has. Obama did, when a jacket company made it look like in an ad that he was endorsing their jacket brand by using a photo of him, wearing their jacket. But very few cases like that.
With amazon, and Printful isn’t the requirement to have a professional selling account $39 per month ??
Or did they drop that requirement?
It is still a requirement, you do need to pay the account fee. If you feel confident in your library of designs though, the $39 fee might be nothing, compared to how much you make back!

👉 I was kind of wondering. I came across a design platform online which offers many arts effects to implement on your photos. Some these arts effects are named after the original artist like Vangogh. The platform does not make any copyright claims, meaning you can sell your new arts images with the Vangogh effects implemented.
👉So here’s my question. If the Vangogh guy comes across your image online with the Vangogh effects on them, will he have the right to sue you?
Interesting question! Art style is not copyrightable, you can’t copyright any particular art style, so a filter that makes your image look similar in style to another picture, seems like it should be OK, but I should note, I am not a lawyer!

Off topic – but is there any way to sell a “bundle” via Printful? I want to create a set of 8 stemless wine glasses – each with a different, but related design – and sell them individually – as well as in a set of 8 – but I can’t see any way to set that up as a product or template in Printful. Can it be done?
Sort of. You can’t automate it, but you can do a manual order with 8 different saved product templates. Doing a manual order with saved templates is very fast. We had to do it a lot during covid. My team got real quick. It would take us 2-3 minutes for each order, haha
@WholesaleTed isn’t it the same as any other variant. Is it like printify? You make drafts of each design don’t publish. Copy past the skus into the etsy listing on the etsy side? I could be wrong.

I was hoping that Printful might have the ability to do let me bundle items together and push them to my store for automatic fulfillment – and ensure that the entire order gets shipped together too (instead of 8 separate packages) – but I guess it’s not the end of the world to do it the way you described. Are shipping fees any cheaper if I order 8 items at once – or is it just 8 times the price of shipping a single item?

The reason CHATGPT is hemorrhaging users is the way they constantly nerf it. It used to be super fun for jokes, playing text adventures, all kinds of stuff, now it just spits nonsense about being woke and respectful and stems content down to what’s acceptable for an 8 year old unless I jump thru a lot of logical hoops with it. Sometimes I just want 20 new puns about farts, not a lecture about how we need to respect the delicate sensibilities about people who eat chili regularly.
It’s because of the GPU issue. They need their computer power to train ChatGPT 5. But, they can’t buy more, because Llama 2 and TruthGPT have even more cash and are buying them instead, pushing their prices up further. The consequence is a less powerful ChatGPT 4. It’s quite interesting honestly
@Wholesale Ted I really don’t think it’s a hardware issue. I’ve never had problems logging into it or using apart from maybe twice in the last year. Sure that keeps them from upgrading the tech as quickly, but as is, it was working amazingly, until they started censoring it more and more with each update. The most import thing is user experience and theirs just keeps getting worse.

Can POD products with Printful’s service on Amazon be listed on Amazon Handmade if i make all my designs by scratch by myself? So not buying digital images but rather making them myself.
I am unsure. They count as handmade on Etsy, but I don’t know what the rules are with Amazon!

Hi Sara. I’m also from NZ and want to start my POD Etsy store. Do your stores specifically target the US market and have US pricing? Is the conversion fee high as compared with having your country’s currency price? Does your course cover topics like opening a US store but from other countries?
I absolutely target the USA and absolutely sell in USD. If you sold in NZD it probably would affect your conversions, since you would artifically make the price look higher than it actually is for them, since our dollar is weak to the USD!
Mugshots are public domain, but some states like CA have made them illegal to sell on merch on the grounds it’s a privacy violation.
The lawyer stated that each jurisdiction chooses, and that not all jurisdictions choose to place them in the public domain. It seems like the federal government does, but each state can choose, and I haven’t seen any confirmation on any interviews with the Fulton County Department confirming or unconfirming what the legal status is there. Until that is provided, legally, I wouldn’t assume it is public domain!

There are some exceptions when it comes to Donald trump’s photo because if you are a trump supporter you might want to get the image printed for a campaign and the campaign isn’t exactly commercial campaign is it
